Protecting Your Rights Despite Financial Hardship
Facing a legal battle is daunting, especially when the opposing party has hired professional lawyers and you are struggling to pay for basic court fees. In Korea, the law ensures that access to justice is not limited by one's economic status. If you are a victim of school violence or any civil injustice but cannot afford a lawsuit, you may qualify for Litigation Aid (소송구조).
What is Litigation Aid?
Litigation Aid is a system where the court, either by request or its own discretion, assists individuals who lack the funds to cover litigation costs.
Key Benefits of Litigation Aid:- Exemption/Postponement of Court Fees: You don't have to pay for court stamps (Inji) or service fees (Songdal-ryo) upfront.- Attorney Fees: The court can appoint a lawyer and defer the payment of their fees.- Other Costs: Deferment of fees for executors and other procedural expenses.
Who is Eligible?
- Financial Requirement: Generally, the court assesses your income and assets. However, if you are a recipient of the National Basic Livelihood Security, a Single-Parent Support beneficiary, or a Basic Pension recipient, you are legally presumed to meet the financial requirement.
- Probability of Success: The aid is granted as long as it is not "obvious that you will lose the case." This doesn't mean you must prove you will win 100%, but the claim must be legally sound and not based on false or extreme grounds.
How to Apply
You must submit an Application for Litigation Aid and a Statement of Financial Status to the court handling your case. If you are a recognized recipient of welfare benefits, simply providing your Recipient Certificate (Sugeupja Jeungmyeong-seo) will simplify the process significantly.
Important Considerations for Victims of School Violence
If you have evidence—such as recorded testimonies from witnesses or social media screenshots—ensure these are prepared. Even if the initial school committee or police investigation was unsatisfactory, you can still pursue a civil lawsuit for damages against the perpetrators and their parents.
Note: Litigation aid does not cover the costs of copying case records.
