Understanding Mental Capacity in Criminal Cases
In the Korean legal system, the mental state of a person at the time of a crime is a crucial factor in determining the severity of punishment. This is especially relevant in cases involving mental disorders like schizophrenia or uncontrollable impulses.
What is 'Diminished Capacity' (Simsin-Miyak)?
According to Article 10 of the Criminal Act, individuals who lack the ability to discern right from wrong or make decisions due to mental disorders are categorized into two types:
- Incompetent Persons (Simsin-Sangsil): Those who have completely lost the ability to distinguish right from wrong. They are generally not punished under criminal law.
- Persons with Diminished Capacity (Simsin-Miyak): Those whose ability to discern right from wrong or act accordingly is significantly impaired, though not completely lost.
Criminal Act Article 10, Paragraph 2: The punishment for a person who, due to mental disorder, has a diminished ability to make decisions or discern objects shall be mitigated.
The Case: Serial Arson and Schizophrenia
Consider a scenario where a person suffering from schizophrenia and an uncontrollable urge to set fires commits eight counts of arson over just six days. If it is determined that these acts were committed while the person was in a state where they could not properly control their actions or understand the consequences, the law views them as a person with diminished capacity.
Conclusion on Punishment
Based on Supreme Court precedents, if a defendant's mental state is proven to be severely impaired at the time of the offense, they are eligible for a reduction in sentencing. This does not mean they are innocent, but rather that their degree of legal responsibility is lowered because of their medical condition.
